Wow, we knew Joe Biden was declining, but hoo boy, this is getting bad. We can only hope and pray he doesn’t do something (else) truly stupid over the weekend, his final one as commander-in-chief.

It’s not clear where he thinks he’s living or who he actually is because he’s behaving as if he’s the Supreme Commander of some imaginary country that doesn’t have laws, three branches of government, or a Constitution. As we’ve been reporting Friday, the president unilaterally declared a new Constitutional amendment and said it was now the law of the land, despite neither of those things being remotely possible under our system of government.

Delusional Joe Biden Declares Equal Rights Amendment Ratified. Catch: He Can’t Do That.
Here’s George Washington University Law Professor Jonathan Turley teeing off on the absurdity:
“In keeping with my oath and duty to Constitution and country, I affirm what I believe and what three-fourths of the states have ratified: The 28th Amendment is the law of the land, guaranteeing all Americans equal rights and protections under the law regardless of their sex.”

Turley followed up with a zinger, “I see dead people”:
Former Assistant United States Attorney for the Southern District of New York, Andy McCarthy basically called the move an utter joke:
“Biden’s announcement is both cynical and irrelevant,” said former Assistant U.S. attorney and Fox News contributor Andrew McCarthy. “If he believed what he is saying, he would’ve said it when his administration started, not when he is on his way out the door as a failed, one-term president.
“More importantly, the president has no constitutional role in the amendment process, so his view carries no weight.”
Despite Biden’s pronouncement, the Equal Rights Amendment is not in effect, and it is simply not the law of the land. It’s hard to know what Joe’s doing here: flat-out lying, trying to wish things into existence, or just no longer aware of what day it is, much less what actually needs to happen for an amendment to be passed.
It’s not complicated; they just plain missed the deadline—decades ago:
The ERA would prohibit discrimination based on gender. It was sent to the states for ratification in 1972, with Congress setting a 1979 deadline for three-quarters of state legislatures to ratify the amendment. The deadline was later extended to 1982.
Virginia became the last state to pass the amendment in 2020, pushing the final number of states who had passed the amendment to a total of 38. McCarthy noted that the ERA “was not ratified by the states within the statutorily allotted timeframe.”

While it can be satisfying to mock the president, because it’s better than throwing shoes at the TV (which can get expensive), the reality is that he’s entering the danger zone at this point. He’s thrown up roadblock after roadblock to Trump’s agenda, and now he’s frankly sounding like an escaped lunatic. It wouldn’t matter if he weren’t still commander in chief of the most powerful country in the world, but unbelievably, he still is.
Let’s all pray he just continues to spout utter foolishness and doesn’t do something more sinister as he burns down his already terrible legacy.
