Suspect accused of shooting, killing man during dispute over barking dogs, BCSO says

  

BEXAR COUNTY, Texas – A 46-year-old man was arrested following a fatal shooting Thursday in southeast Bexar County, authorities said.

Michael Dimaggio was taken into custody after allegedly shooting a 39-year-old man during a confrontation outside Dimaggio’s home, the Bexar County Sheriff’s Office said.

The incident happened just before 9 p.m. in the 6600 block of Harry Road near Elmendorf.

BCSO said the victim, identified by the Bexar County Medical Examiner’s Office as 39-year-old Justin Bergh on Friday, reportedly approached Dimaggio. Bergh was walking his two dogs, and complained about the dogs barking.

Witnesses said an argument ensued, and Bergh allegedly threatened Dimaggio and hit him in the face, according to BCSO.

Dimaggio went inside his home and returned outside, telling Bergh to leave his property, authorities said.

Witnesses reported that Bergh lunged at Dimaggio, and Dimaggio shot him in the chest, the sheriff’s office said.

Bergh was pronounced dead at the scene and Dimaggio was taken into custody.

The medical examiner’s office said Bergh died from a gunshot wound to the chest. His death was ruled a homicide.

Dimaggio reported he had chest pains after his arrest and was taken to a hospital. A revolver was later recovered during a search of his trailer, officials said.

Dimaggio remains in custody and is pending a charge of murder, according to the sheriff’s office.

The investigation is ongoing.
