Ashley Marmolejo faces a murder charge for allegedly providing the gun used in a fatal Sonic Drive-In shooting by her 12-year-old nephew.
KEENE, Texas — A woman accused in the death of a North Texas Sonic employee is now facing a charge of murder, court records revealed.
Ashley Marmolejo was originally charged with manslaughter, but that charge has been upgraded in a deadly shooting where the convicted gunman was a child.
According to the Johnson County District Attorney, Mamolejo admitted giving her then 12-year-old nephew the gun used to kill Matthew Davis, an employee at the Sonic Drive-In in Keene, on May 14, 2023.
It happened after Davis got into an altercation with the boy’s uncle, who reportedly was confronted by Davis for urinating in the parking lot. Davis was shot multiple times, although Ashley Marmolejo said in court records that her nephew was only supposed to scare him with the gun.
Davis’ mother told WFAA she worked non-stop seeking justice in her son’s shooting death.
“I love my son. I miss my son every day. She’s been walking free this whole entire time on a charge of manslaughter when it should’ve been murdered all along,” said Leigh Miller, “and justice was served and it was made right in Johnson County Texas today.”
Venus police officers arrested Mamolejo on Feb. 5 on behalf of Keene Detectives. She was booked into the Johnson County jail without bond.
Court records show a trial is set in July.
