TYLER, Texas — The final person out of three people involved in the deadly robbery of an East Texas veteran in February 2023 had his capital murder charge dismissed.
Anthony Taylor was arrested back in August 2023 along with Stephanie Brasher and Herbert Simpson after DNA evidence connected them to the scene of where Warren Rogers, 61, of Tyler, was shot and killed on Feb. 6, 2023.
During a plea hearing Thursday, Smith County Assistant District Attorney Noah Coltman said Taylor’s involvement in the shooting was limited to him being the driver, and the office decided to dismiss the charge as that was the extent of his involvement.
Separately, Taylor pleaded guilty to possession of a controlled substance and the judge issued a 12-month sentence based on the agreement.


According to documents, the trio worked together around Feb. 6, 2023, to kill Rogers and steal his CashApp debit card and electronic devices at his home on W. Mims Street in Tyler. DNA showed that Simpson’s blood was found at the scene and a Dr Pepper bottle at the apartment had Brasher’s DNA on it.
An arrest affidavit said Taylor drove Simpson and Brasher to Rogers’ apartment and they dropped her off, the document read.
Brasher was sentenced to 38 years in prison for her role in Rogers’ death in February. Simpson was found guilty and sentenced to life in prison without parole after a trial last December.
