Committee seeks public comments on proposed ethics opinions

The Professional Ethics Committee for the State Bar of Texas is accepting public comments on the following proposed ethics opinions:

Proposed Opinion 2023-1 (comment deadline 4/14/2023): Under Texas Disciplinary Rules of Professional Conduct, may a lawyer-defendant in a legal malpractice case enter into a settlement agreement in which the lawyer-defendant assigns to a non-lawyer plaintiff a portion of contingent fees the lawyer-defendant may earn in unrelated cases?

Proposed Opinion 2023-2 (comment deadline (4/15/2023): Under the Texas Disciplinary Rules of Professional Conduct, is a lawyer permitted or required to turn over a closed litigation file of a deceased client to the executor of the decedent’s estate when the file is not related to matters affecting the estate or its administration?
