East Texas father, grandmother arrested for accusations of physically abusing 3-month-old boy

The ER physician said the infant had a broken right clavicle and his right arm had to be splinted to his chest to heal, the sheriff’s office said.

SMITH COUNTY, Texas — The father and grandmother of an East Texas infant were arrested Wednesday for allegedly physically abusing the boy.

Zachray McGinn and Brittany Mackey are both charged with injury to a child in connection with a 3-month-old boy who was taken to the hospital for significant injuries that appeared to be child abuse. McGinn is the father of the child and Mackey is the boy’s grandmother, according to the Smith County Sheriff’s Office.

A deputy responded to a Tyler hospital, where the boy was receiving treatment, on Wednesday evening. The attending nurse said the infant was “lethargic, weak, and had bruises on the face and neck.” An investigator confirmed the injuries as well, the sheriff’s office said.

After speaking with the child’s mother, the investigator learned the boy had just come home after spending several days with McGinn at a home on County Road 2192 near Whitehouse. The mother said McGinn and Mackey dropped off the child at her home on Wednesday, and the mother then saw child’s lethargic manner and bruising to the face, according to the SCSO.

The boy was soon taken to the emergency room. The ER physician said the infant had a broken right clavicle and his right arm had to be splinted to his chest to heal, the sheriff’s office said.

Following a search of the County Road 2192 home, McGinn and Mackey were detained and later arrested after investigators obtained warrants. Their bonds were set at $250,000 each, the SCSO said.
