The family is seeking damages of up to $1 million, according to court documents.
DALLAS — The family of a woman who died after allegedly choking on food at a North Texas group home earlier this year is suing the group home, citing negligence, according to court documents.
According to the lawsuit, which was filed Thursday in Dallas County, the woman, Francesca Camareno, 39, was admitted to Daybreak Community Services in DeSoto in 2022 and choked while eating breakfast on July 24, 2024.
The facility is located in the 300 block of Parakeet Drive.
Camareno was taken to a Dallas medical center but was pronounced dead a few days later on July 29, according to the Dallas County Medical Examiner’s Office. Her manner of death was listed on the medical examiner’s website as an accident.
“Ms. Camareno required supervision and assistance with eating and her meals were supposed to be specially prepared for her,” the lawsuit alleges. “Daybreak staff failed to supervise Ms. Camareno during her breakfast, allowing her to choke on her food.
The lawsuit alleges that the group home failed to properly supervise Camareno while she was eating, failed to ensure Camareno’s health care plan, doctor’s order, policies and procedures were implemented or complied with, and failed to ensure adequate assessment and evaluation of Camareno on a timely basis, among other things.
The lawsuit seeks damages of up to $1 million, court documents show.
WFAA has reached out to Daybreak Group Home for comment Friday and has yet to hear back.
